HYUNDAI KIA OIL PUMP RECALL CAUSES CLASS ACTION LAWSUIT - LEMON LAW
A second Hyundai oil pump recall caused a Hyundai owner to file a class action lawsuit which alleges the oil pump recall won't permanently fix the vehicles. Oddly, this is very similar to the recall Hyundai / Kia issued for the Sorento not too long ago, written about here.
In August 2023, Hyundai announced a recall of over 50,000 of these vehicles in the U.S., namely:
2023-2024 Hyundai Palisade
2023 Hyundai Tucson
2023 Hyundai Kona
2023 Hyundai Sonata
2023 Hyundai Elantra
According to Hyundai, defective oil pumps may impact 1% or fewer of the vehicles. In addition, Hyundai is aware of four "thermal" accidents out of 52,000 vehicles.
The company advises owners to keep driving their cars, but to park them outdoors until they are fixed.
In April 2023, John Franz of South Carolina bought a 2023 Hyundai Tucson with an odometer reading of roughly 3,100 miles.
Class Rep Franz claims that even if his car hasn't been fixed, the replacements or repairs won't solve the problem. Furthermore, the complaint claims there is no assurance the replacement oil pump components won't malfunction even if Hyundai is replacing the oil pump components at no cost with updated parts.
"Any fixes to this vehicle are no more than temporary solutions to a faulty vehicle," the Franz claims.
The Hyundai oil pump class action lawsuit was filed in the U.S. District Court for the Central District of California: John Franz v. Hyundai Motor America.
