Nissan CVT Class Action Settlement (Again) and Warranty Extension Notice in Martinez v. Nissan
Another day, another Nissan CVT Class Action Settlement and warranty extension. By my count, this is approximately the 5th class action lawsuit involving Nissan CVT transmissions to settle, those prior being:
Weckworth v. Nissan (2013 - 2017 Nissan Sentra, Nissan Versa and Nissan Versa Note)
Gann v. Nissan (2013-2016 Nissan Altimas)
Stringer v. Nissan (2014-2018 Nissan Rogue, Nissan Pathfinders and Infiniti QX60)
Bautista v. Nissan ( 2013-2014 Nissan Pathfinders)
Now, another Nissan CVT settlement has been preliminarily approved for the following vehicles:
2017-2018 Nisan Altima
2018-2019 Nisan Sentra
2018-2019 Nissan Versa
2018-2019 Nissan Versa Note
The name of this class action is Minerva Martinez v. Nissan North America, Inc and the claims revolve around the same issues as all the prior class actions, namely that the CVT transmission shakes / shudders upon acceleration, overheats, judders, clunks and jerks during the normal course of driving. Valero Law has written about this in about 20 different online notices to consumers, as seen
Similar to the prior class action settlements, putative class members should receive the following:
WARRANTY EXTENSION - The Settlement provides an extension of the Nissan New Vehicle Limited Warranty on your Class Vehicle’s transmission from 60 months / 60,000 miles to 84 months / 84,000 miles (whichever occurs first) (the “Warranty Extension”).
REIMBURSEMENT PAYMENTS - NNA will reimburse Class Members 100% of the amount they actually paid for parts and labor to an authorized Nissan dealer (or up to $4,750 paid to a non-NNA repair facility).
Current and former owners who had two or more replacements or repairs to the transmission assembly (including the valve body and torque converter) or ATCU during their ownership (as reflected by warranty records) are eligible for a voucher in the amount of $1,000 for either a purchase or lease of a new Nissan or Infiniti vehicle.
As discussed in prior notices, though, it may be more beneficial to pursue an individual lemon law action since the recovery may be greater than the class-wide treatment that one receives class-settlement.
