Nissan Pathfinder Hood Recall
In June 2022, Nissan initiated a recall affecting nearly 360,000 model year 2013-2016 Pathfinder vehicles due to a defective secondary hood latch that could cause the hood to unexpectedly open while driving. This issue was attributed to contamination and corrosion around the latch mechanism, potentially leading to the latch remaining unlatched even when the hood is closed. After nearly three years, Nissan has announced that the necessary replacement parts are available, and dealerships are prepared to perform the required repairs.
For California consumers, this prolonged delay raises important considerations under the state's Lemon Law. The California Lemon Law, officially known as the Song-Beverly Consumer Warranty Act, provides robust protections for consumers who have purchased or leased new vehicles with persistent defects. If a manufacturer is unable to repair a vehicle's defect after a reasonable number of attempts, the consumer may be entitled to a replacement or refund. The law applies to defects that substantially impair the vehicle's use, value, or safety.
Determining what constitutes a "reasonable number" of repair attempts can depend on various factors, including the severity of the defect and its impact on safety. For safety-related issues, such as a hood that may open unexpectedly while driving, even two repair attempts might be considered sufficient to invoke Lemon Law protections. Additionally, if a vehicle has been out of service for more than 30 cumulative days due to repairs, this may also meet the criteria under the Lemon Law.
