Lemon Alert - Nissan Altima, Nissan Sentra, Nissan Versa - Minerva Martinez v. Nissan North American
Be on the lookout in your mailbox because postcards in the class action Minerva Martinez v. Nissan North America, Inc should be going out in late October / Early November. This class action is very similar to all the other Nissan CVT class actions that involve problematic CVT transmissions that have a tendency to shake, shudder, jolt and hesitate during acceleration and also result in replacement of the CVT transmission, which can typically cost around $4,000.

Similar to the prior class action settlements, putative class members should receive the following:
WARRANTY EXTENSION - The Settlement provides an extension of the Nissan New Vehicle Limited Warranty on your Class Vehicle’s transmission from 60 months / 60,000 miles to 84 months / 84,000 miles (whichever occurs first) (the “Warranty Extension”).
REIMBURSEMENT PAYMENTS - NNA will reimburse Class Members 100% of the amount they actually paid for parts and labor to an authorized Nissan dealer (or up to $4,750 paid to a non-NNA repair facility).
Current and former owners who had two or more replacements or repairs to the transmission assembly (including the valve body and torque converter) or ATCU during their ownership (as reflected by warranty records) are eligible for a voucher in the amount of $1,000 for either a purchase or lease of a new Nissan or Infiniti vehicle.
As discussed in prior notices, though, it may be more beneficial to pursue an individual lemon law action since the recovery may be greater than the class-wide treatment that one receives class-settlement.
