Honda Civic and CR-V Oil Dilution Settlement Receives Preliminary Approval
Owners of 2016-2018 Honda Civics and 2017-2018 Honda CR-Vs equipped with 1.5-liter Earth Dreams turbocharged engines have noticed that their vehicles have consumed excess amounts of oil, which has resulted in poor engine performance, engine misfires, and otherwise poor performance. The oil consumption issue has also caused oil dilution, where engine oil can become contaminated with fuel. Or, as the plaintiffs allege, the oil dilution can cause the crankcase to overfill with fuel-contaminated engine oil, "causing it to become aerated and foamy when it comes into contact with the crankshaft, leading to insufficient lubrication and overheating."
The class action applies to “All current and former owners or lessees of MY 2017‐18 Honda CR‐Vs with the 1.5 liter turbocharged engine or MY 2016‐18 Honda Civics equipped with the 1.5 liter turbocharged engine, who reside in, and who purchased or leased their vehicles (other than for purposes of resale or distribution) in the United States, Puerto Rico, and all United States territories”
Per the Preliminary Approval order, potential class members are set to receive :
extend the existing Powertrain Limited Warranty an additional year (see id. ¶¶ 3.2–3.4);
reimburse certain towing expenses incurred before the date by which Honda completes serving notice on the putative settlement class members (the “Notice Date”) (see id. ¶¶ 1.14, 3.5–3.4);
reimburse certain oil change costs incurred before the Notice Date (see id. ¶¶ 3.7–3.8);
reimburse up to $250 of certain diagnostic costs incurred before the Notice Date (see id. ¶¶ 3.9–3.10);
provide a Product Update to Class Vehicles registered in certain cold‐weather states so that they receive software updates that will reduce the likelihood that the defect manifests (see id. ¶ 3.11, ECF No. 74 at 6.).
